Our “Services” include property Sales and Lettings; Agricultural Services; Farm Machinery Sales & Auctions, Surveys & Valuations; (hereafter these are collectively known as our “Services”).

Information required to comply with legislation such as Right to Rent checks required under Section 22 of the Immigration Act 2014 if you are renting a property and The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (more commonly referred to as the Money Laundering Regulations 2017) which is a legal requirement for a number of our Services.
  3. Information to enable us to tailor our marketing and communications to you, based on your personal preferences, such as the types of service you are looking for, the location of your search area, the budget you are willing to spend etc. (hereafter “Criteria”).

Tenant referencing agencies, banks or lending institutions, solicitors, surveyors, other estate agents or landlords, local authorities, contractors and property maintenance services, gas and electrical contractors, utility companies and insurance providers.

Sales – Residential, Commercial, Agricultural, Surveying and Financial Services.

For the purpose of our legitimate business interests we may be required to share some of your personal information with, including but not limited to:

Solicitors/conveyancers, surveyors, financial/mortgage advisors, banks & lending institutions, local authorities, other estate agents in a chain, contractors and property maintenance services, utility companies and removal businesses.

Software and system providers including but not limited to Reapit Software, Sage, Iam-Sold, Brief Your Market, Fixflo, MoneyPenny, Feefo.

Website Hosts and analytics platform providers including but limited to, Rackspace, Extraordinary Managed Solutions, Google Analytics, Google AdWords Remarketing & the Google Display Network.

We require that these service providers and other third parties adhere to strict rules when processing your personal information, including to only use your personal information in accordance with our specific instructions (such as for the purposes of completing referencing or contacting you to arrange access to carry out necessary repairs) and the applicable laws.

With Legal and Law Enforcement

Will Barker & Co will disclose personal information where required by law or legal process, for the administration of justice, to protect your vital interest, for investigations by law enforcement or regulatory bodies, to protect and defend Will Barker & Co property and legal rights, to protect the personal safety of our website users or by order of a valid injunction from a court or law enforcement agency.

In Relation to Business Interests

In the event that we sell or buy any business or assets, we may disclose your personal data to the prospective seller or buyer of such business or assets.

If Will Barker & Co is or all of its assets are acquired by a third party, personal data held by us about our customers will be one of the transferred assets.

HOW LONG DO WE STORE YOUR INFORMATION FOR?

Personal Information

The length of time we hold your information for will vary dependent on lawful basis for collecting and processing the data.

Will Barker & Co will hold data supplied where there is a legitimate interest in doing so (such as where a client or customer has registered with us, expressing an interest in in any of our Services such as buying, selling, letting or renting through us) for a period of 7 years.

Where a transactional relationship has been entered into and there is a contractual necessity to do so, or where there is a requirement to comply with regulatory or legal obligations (for example in order to comply with the requirements of The Property Ombudsman, The Royal Institute of Chartered Surveyors and HM Revenue and Customs Anti Money Laundering Regulations 2017) we will keep all personal information for a period of 15 years.

Website Account Information

If you have an Account on our Website and it has been deemed dormant then we may delete the Account and all information “tied to” or “held against” it. We consider an Account to be dormant if one of the following conditions is met:

  • it has not been accessed by you for more than 1 year,
  • if you have not responded to any emails sent to the registered email address,
  • if we receive email delivery failure notifications in response to any email sent to the registered email address,
  • the Account is in breach of our Terms of Use.

STORAGE

All information you provide to us is stored in the UK on our secure (password and firewall protected) servers and all paper based information is also securely stored in the UK. All electronic transactions and data transmissions between your Device and our Website will be encrypted using industry-standard SSL (Secure Socket Layer) technology; and our website has a SSL certificate from GlobalSign, a WebTrust-certified certificate authority. ACCESS TO, DELETION, AND CORRECTION OF PERSONAL INFORMATION

You can update some of your personal information by signing in to your Account on our Website using your email address and password. In addition, you may contact us and we will be able to update your records on our data management systems – please let us know if the personal information which we hold about you needs to be corrected or updated.

If you would like to know what personal information Will Barker & Co holds about you, you may make a request to Will Barker & Co for copies of this information. TELEPHONE CALL RECORDING

All calls to and from us are recorded, and such calls may contain personal information. When a call is recorded, we collect a digital recording of the conversation, the date and time of the call and the number telephone numbers of both parties if available.

Telephone call recording will be turned off, when a customer’s credit or debit card details are giving, in line with Payment Card Industry Data Security Standards (PCS DSS) and General Data Protection Regulations (GDPR).
Call recordings may be used to:

  • Assist in the quality monitoring of staff performance and training
  • Investigate and resolve complaints
  • For the detection, investigation, and prevention of crime (including fraud)
  • To take actions to protect staff from abusive callers
  • To ensure Will Barker & Co is able to monitor and adhere to quality standards.

All recordings are held securely by our IT team. Only a director of the company can request access to a recording. All call recordings will be held confidentially and deleted after 13 months, unless there is a legitimate reason to keep a specific recording longer.

We may be required to share a call recording in order to respond to a complaint. We may also be required or permitted under data protection legislation, to disclose a call recording, including your personal information without your explicit consent, for example if we have a legal obligation to do so.

Recording of calls in necessary to protect the interests of you, our customers and our staff. It’s also in our legitimate interests, unless those interests are overridden by you by asking for your call not to be recorded. You may request that your call isn’t recorded. In this situation, you will normally be advised to contact us either in writing or by email.

PERSONAL DATA BREACHES

In order to comply with applicable law, Will Barker & Co has implemented procedures to detect, report and investigate personal data breaches.

A data breach is defined by the Information Commissioner’s Office (ICO) as;

“A breach of security leading to the destruction, loss, alteration, unauthorised disclosure or, or access to, personal data.”

The ICO will be informed of all data breaches which present a high risk to our clients and customer’s rights and freedoms and in line with applicable law, a notifiable breach will be reported within 72 hours of us becoming aware of it. The individual(s) involved will also be informed.
